Prima Prep (“PrimaPrep”) maintains this website, any courses offered and other linked and related sites (the “Site”) for the use of its customers, vendors, students, and other Site users (“Users”) upon agreement to the following terms. Please read the terms carefully before using the Site. Use of this website indicates acceptance of these “Terms of Service” and forms a binding agreement between you and PrimaPrep. If you do not agree to these terms, do not use this Site.

Liability Limitation

PrimaPrep makes no warranties or representations as to the performance or merchant ability of the products or services referred to on this web site. PrimaPrep is not liable for any damage to hardware or software by anyone accessing this web site, or for loss of business or profits, or for any consequential damages made by any party using the information on this web site for any cause whatsoever, regardless of the form of action.

PrimaPrep provides links to third party web sites for use by interested parties. PrimaPrep is in no way affiliated with these third parties and makes no representations regarding these sites or use of products or services from these sites. We do not endorse any product or service or its appropriateness. We have not confirmed the accuracy or reliability of any of the information contained on any third party’s site.

Warranties

PrimaPrep makes no warranties or representations regarding the information provided by third parties or to the performance or the merchant ability of the products or services referred to on third party sites. We do not make any representations or warranties as to the privacy or security of any information, including credit card information, you may be requested to give to a third party.

Use of Site & Services

PrimaPrep provides various materials, information, quizzes, tests, questions, articles, news and other information on this and related sites and in courses offered through this site (the “Materials”), and tutor/coaching based educational services (the “Services”). PrimaPrep provides various videos in courses offered through this site (the “Videos”). PrimaPrep authorizes each User to view and download one copy of the Materials. PrimaPrep authorizes each User to views the Video only. Materials may be downloaded and a maximum of one copy of the Materials may be printed provided that Users make no modifications to the Materials and Users retain all copyright and other proprietary notices contained in the original Materials on any copies of the Materials. Users may not modify the Materials at this Site in any way or reproduce, share or distribute them. Users will keep all Materials confidential, and will not sell, auction, loan, rent, give away, describe, summarize, or otherwise reveal the Materials or their contents, to any other person or entity. PrimaPrep may provide Users with access to Materials for limited period after initial registration. Any breach of these Terms of Service automatically terminates your authorized use of the Site.

PrimaPrep provides information and guidance about law school admissions and exams in it’s Materials and Services. PrimaPrep does not make any warranty of any kind (expressed or implied) as to the results that may be obtained from use of its Materials or Services. In particular, PrimaPrep does not guarantee that the Materials will improve your chances of admission to law school, or that you will be admitted to any law school, or that your LSAT test score will improve. PrimaPrep is not responsible for any loss, injury, claim, liability, or damage (including but not limited to: rejection from any law school, drop in LSAT score, etc.) related to your use of the Materials or Services, whether it be from errors, omissions, advice, or any other cause whatsoever. Your use of the Materials and/or Services is at your own risk.

User Warranty

As a User you warrant that you are not an agent or employee of any other test preparation company and using the Site and Materials solely for the purpose of increasing your LSAT score, law school admissions, law school grades, or MBE score.

Revision of Terms of Service

PrimaPrep may at any time revise these Terms of Service by updating this posting. By using this website, you agree to be bound by any such revisions and should therefore periodically visit this page to determine the then current Terms of Service to which you are bound.

All materials, names, and terms on the Site are the property of PrimaPrep except where otherwise noted. Nothing on this website should be construed as granting, by implication, or otherwise, any license or right to use any of these materials, names, terms, and trademarks displayed on this website, without the written permission of PrimaPrep. None of the material may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means, including, but not limited to, electronic, mechanical, photocopying, recording, or otherwise, without the prior written permission of PrimaPrep. Any unauthorized use of any material contained on this website may violate copyright laws, the laws of privacy and publicity, and communications regulations and statutes. PrimaPrep enforces its intellectual property rights to the fullest extent of the law.

User Generated Content

You grant PrimaPrep a perpetual, nonexclusive, world-wide, royalty free, sub-licensable license to the submissions, which includes without limitation the right for PrimaPrep or any third party it designates, to use, copy, transmit, excerpt, publish, distribute, publicly display, publicly perform, create derivative works of, host, index, cache, tag, encode, modify and adapt (including without limitation the right to adapt to streaming, downloading, broadcast, mobile, digital, thumbnail, scanning or other technologies) in any form or media now known or hereinafter developed, any submission posted by you on or to any website owned by PrimaPrep, including any submission posted on or to PrimaPrep through a third party.

Privacy and Marketing

You grant PrimaPrep authorization to contact you and use the information we collect for internal purposes including marketing. We will not disclose, sell or release your information to any third parties without your approval. PrimaPrep will comply with relevant privacy laws under which the company is required. Please forward any privacy related concerns directly to info@primaprep.com.

Invoicing and Payment

All payment for materials, content, courses, and/or services are due immediately, and must be paid before services are provided. For students subscribing to tutoring/coaching services specifically, payment must be made before any session(s) begin, either by purchase of individual hourly sessions, and/or package rates.

Method of Payment

Payments must be made either by cash or by interac e-transfer (send to: billing@primaprep.com). Credit cards and/or cheques are not accepted.

Refunds

All products and services sold by PrimaPrep are non-refundable including pre-paid sessions and packages and expire within one year of purchase unless otherwise expressly written. All pre-paid sessions and/or packages must be utilized in full within one year of purchase date or will be forfeited. Students may at the end of this one-year term contact PrimaPrep directly in order to arrange an extension at the cost of 10% of the original total price for a maximum of a one-month extension, bringing the total expiration date to 13 months from the original purchase date.

Session Rate Increases

All students who have not purchased a package may be subject to future rate increases to the ‘Pay-As-You-Go’ hourly option. All rate increases will be posted to relevant pricing lists and/or communicated to current students in advance.

Students who have subscribed to pre-paid sessions and/or packages will not be affected by rate increases for services already paid for. Special additional hourly rates that are offered as a benefit of package subscription however, may be subject to similar price increases as noted above.

Students are responsible to give at least 24 hours notice for any session cancellations and/or time changes. Should less than 24 hours notice be given, a non-refundable fee equivalent to 1/2 the cost of a regular 1hr session will be charged to the student. This fee must be paid before any further session(s) will be booked.
